1. Purpose

SARL NORMELIA ("CPARICI") offers a matchmaking service between :

on the one hand :

Individuals and/or professionals ("Individual Advertisers" and "Professional Advertisers", collectively referred to as "Advertisers") wishing to offer services and properties for rent via advertisements ("Advertisements").

On the other hand :

Individuals and/or professionals ("Visitors") interested in these services and goods.

This service is accessible via the online platform at https://cparici.com/fr ("The Website").

These General Terms and Conditions of Use ("GTCU") are the sole document governing relations between CPARICI and Advertisers. They define, without restriction or reservation, the rights and obligations of each party concerning the use of the services. Acceptance of the GCU is a prerequisite for access to the services and content of the website.

3. Conditions of access to services

Services are available to :

Individuals of legal age who have the legal capacity to accept the GCU.
Legal entities represented by a person authorized to contract on their behalf.

4. Advertiser status

Advertisers can be :

Professionals: any individual or legal entity acting in the course of a commercial, industrial, artisanal, agricultural or liberal activity.
Individuals: any natural person offering goods or services.

5. How to register

To subscribe to the services, the Advertiser must :

Fill in the registration form with the required information (last name, first name, email).

or 

Use an account on an authorized third-party site, giving access to the necessary data. He/she authorizes CPARICI to access the data in this account.

Incomplete registrations will not be validated.

Registration leads to the creation of an account ("Account") enabling the creation and management of advertisements.

6. Acceptance of the General Terms of Use (GTU)

For Advertisers :

Registration on the website implies full and complete acceptance of the GCU by clicking on the registration button. Any conditional acceptance will be considered invalid. Refusal to accept the GTCU prevents use of the services.

For Visitors :

Visitors can either :

-Search, consult Advertisements and contact Advertisers without prior registration on the website (the "Visitor"). The Visitor will then be asked to accept the Platform's General Terms and Conditions of Use when sending his/her message to the Advertiser.

In this case, the Visitor's acceptance of the General Terms of Use is evidenced by a function that must be clicked on when registering on the website. This acceptance must be full and entire. Any conditional acceptance is considered null and void. Visitors who do not agree to be bound by the General Conditions of Use may not use the Services requiring their registration on the website.

Registration automatically leads to the opening of an account in the Visitor's name (the "Account"), enabling the Visitor to manage his or her use of the Services on the Site, using his or her login and password.

7. Service description

Advertisers and Visitors acknowledge that use of the services requires an Internet connection, for which CPARICI cannot be held responsible.

Within the framework of the Services, the Advertiser and the Visitor are informed and expressly acknowledge that CPARICI offers a service to put Advertisers and Visitors in contact with each other via the Internet site, enabling them to find a good or service.

Any visitor can freely search, view ads and contact advertisers without having to register.

CPARICI provides a link between Advertisers and visitors and cannot be held responsible for any dispute, whether material or immaterial, arising from the relationship between these parties.

7.1 Matchmaking service

CPARICI offers advertisers a space ('an ad page') for a limited period of time, which may be consulted by Visitors. CPARICI cannot be held responsible for any disputes arising between the parties (damages, payments, etc.).

The use of and/or connection to the website via an account does not constitute a travel or holiday contract within the meaning of the French Tourism Code and does not constitute a service contract with the advertiser.

CPARICI does not intervene in contracts concluded directly between Advertisers and Visitors. CPARICI does not position itself as a travel agency, insurer or organizer in accordance with Directive (EU) 2015/2302.

7.2 Creating and publishing Advertisements

After creating their account and making payment, Advertisers may publish Ads, after validation by CPARICI, including descriptions and photos. Advertisers undertake to provide accurate information and to comply with any applicable legal declarations or prior authorization requirements. (article L.324-1-1 of the French Tourism Code, articles L.631-7 et seq. of the French Construction and Housing Code)

The Advertiser undertakes to write the description of the services or goods in the Advertisements in a sincere, truthful and complete manner, providing precise and objective information corresponding to the actual characteristics of the services and goods.

The Advertiser undertakes not to offer any goods or services whose characteristics differ from those indicated in the Ad.

Ads are classified according to criteria defined by CPARICI.

7.3 Viewing ads

CPARICI offers Visitors the possibility of searching and viewing Advertisements on the Website.

7.4 Control panel

Advertisers can, via their Account: modify the characteristics of their ads, indicate their availability, ato their own terms and conditions, complete their profile.

7.5 Contacting Hosts

CPARICI offers Visitors interested in a service or property to rent, the possibility of contacting the Advertisers to obtain specific information on the services and properties to be rented by means of a form to be completed, proposed for this purpose and accessible on the Internet site.

The Advertiser will receive the information request by email.

The Visitor may also be invited to visit the Advertiser's website if the latter has one. Each professional can add a direct link to its own website, however, links to third-party booking platforms (such as Airbnb, Booking, etc.) are not permitted.. Visitors acknowledge and accept that : 

The e-mail service is not infallible and depends on the connection and access providers to the telephone network and Internet over which CPARICI has no control;

7.6 Reservation request service

Visitors can contact Advertisers via a form on the website. The Advertiser receives requests directly by email.

Advertisers acknowledge that the reception of messages may depend on their access provider and may generate charges.

If a reservation request is successful, the conclusion of the service or property rental contract, payment and management of the rental terms (arrival and departure times, services provided, etc.) will be carried out directly between the Advertiser and the Visitor, under their entire responsibility.

7.7 Cancellation policy of the reservation of the service or rental of the property by the Advertiser

Any cancellation of a reservation, whether made by a Professional or Individual Advertiser, is the sole responsibility of the Advertiser and must be made in accordance with the terms and conditions specified by the Advertiser.

7.8 Cancellation policy for reservation of services or rental of property by the Visitor

If the advertiser is a professional, cancellation of the reservation of the service or vacation rental by the Visitor is subject to the terms and conditions defined in the Visitor's general terms and conditions.

In any event, the cancellation request made by the Visitor to the Advertiser is made under the Visitor's sole responsibility and in accordance with the terms and conditions indicated by the Advertiser on the website.

Any complaint or request for reimbursement by the Visitor must be made directly to the Advertiser.

8. Service subscription period

8.1 Subscription period for listing services

The Advertiser, whether Professional or Individual, subscribes to the Services in the form of a subscription (the "Subscription Pack").

The Subscription takes effect from the date of subscription and is valid for an initial period of 12 months, or longer in the case of a specific offer.

The Subscription is automatically renewed for successive periods of 12 months, unless terminated in accordance with the terms and conditions set out in the "Termination of Services" article.

When the Advertiser is an Individual Advertiser, the renewal of the Subscription will be subject to the provisions of articles L215-1 et seq. of the French Consumer Code.

9. CPARICI pricing conditions

9.1 Service prices

For the Advertiser :

The rates for the Subscription taken out by the Advertiser, whether Professional or Individual, are specified on the website.

Any period started as part of the Subscription must be paid in full, with no possibility of partial reimbursement.

Other services other than advertisements are subject to a specific quote depending on the services offered by CPARICI.

For the Visitor : 

The Services are provided to Visitors free of charge.

9.2 Prices for Services and rental properties

The prices of services and rentals are indicated in the Advertisements and are set directly by the Advertisers.

Prices are quoted in euros and include all taxes. Prices may be modified at any time by the Advertisers. Additional costs may be added to the Price, payable directly to the Advertiser. Consequently, the Visitor acknowledges that it is his responsibility to check any additional costs that may be added to the Price indicated on the website.

9.3 CPARICI invoicing and payment methods

About the Announcement Service

As part of the Advertising Services, CPARICI will send the Advertiser, whether Professional or Individual, an invoice for the Subscription for each period.

Payment for the Subscription will be made :

By credit card via the secure online payment system available on the website, when subscribing to the Subscription, and each time it is renewed.

By direct debit at each renewal.

Concerning other Services.

For other Services, CPARICI will send the Advertiser an invoice for the service subscribed to by email.

Payment for other Services will be made :

By credit card using the secure online payment service specified on the Platform, each time the said service is subscribed to.

Or by bank transfer.

10. Website maintenance and hosting

10.1 Maintenance

For the duration of the Services, the Advertiser and Visitors benefit from corrective and evolutionary maintenance of the Internet site. As such, access to the website may be temporarily restricted or suspended.

CPARICI undertakes to implement all necessary means to ensure effective corrective maintenance, aimed at resolving any malfunction or anomaly identified on the website.

Within the framework of evolutionary maintenance, the Advertiser and the Visitor benefit, for the duration of the Services, from improvements to the functionalities of the Internet site and the associated technical installations. These improvements may be implemented by CPARICI automatically and without prior notice.

Access to the website may also be restricted or interrupted for planned maintenance operations.

10.2 Hosting

CPARICI ensures, within the framework of an obligation of means, the lodging of the Internet site as well as the data seized by and/or on this one via a professional provider of lodging, located in a country of the European Union.

11. Individual Advertiser's right of withdrawal

The right of withdrawal is valid for 14 calendar days from acceptance of the General Conditions of Use. The Individual Advertiser may exercise this right free of charge by sending his request to CPARICI before the expiry of this period by e-mail to annonceur@cparici.com.

This request must be clear and must include the words "Withdrawal request".

If the Individual advertiser confirms that their ad will be placed online, after having created their ad, they waive their right of withdrawal.

If the Individual Advertiser exercises his right of withdrawal, CPARICI will reimburse all payments received as soon as possible.

12. Legal warranty of conformity to the Individual Advertiser

The legal warranty is applicable to any Individual Advertiser who is a consumer in respect of his or her use of the website.

The consumer has the right to the implementation of the legal guarantee of conformity in the event of appearance of a defect of conformity during the duration of the Services. In this case, the consumer may obtain a refund calculated on a pro rata basis of the Services provided up to the day CPARICI was informed.

CPARICI cannot be held responsible for any interruption of the website due to the host, CMS or extensions.

13. Intellectual property rights

13.1 Intellectual property rights on the website

The website is the property of CPARICI, as are the software, infrastructures, databases and content of all kinds (text, images, visuals, music, logos, trademarks, etc.) that it uses. These elements are protected by current laws on intellectual property and the rights of database producers.

13.2 Intellectual property rights on Content and testimonials

By using the Services, the Advertiser acknowledges that any content it publishes on the website (the "Content") is shared in a spirit of collaboration and community exchange.

The advertiser agrees that CPARICI may publish the Content and testimonials of advertisers on the website and on social networks in France and abroad through any media and medium, in order to promote the website, translate the Content into any language, modify and/or adapt the Content to formats.

By registering on the site, the Visitor acknowledges that the content of any kind that he/she publishes on the Platform, and in particular comments concerning his/her stay (the "Content"), is disseminated in a spirit of community exchange.

He/she authorizes CPARICI to use his/her testimonials, his/her image attached to his/her account on any digital or paper marketing medium for the sole purpose of promoting the website.

14. Advertiser's obligations and liability

14.1 Information provided

The Advertiser agrees to provide CPARICI with all information required for the subscription and use of the Services.

14.2 Concerning the Advertiser's Account

The Advertiser attests to the accuracy of the information provided in the registration form and undertakes to update it regularly. He acknowledges that this information constitutes proof of his identity and binds him as soon as it has been validated. The Advertiser is also responsible for ensuring the confidentiality and security of his/her login and password, all access to the site via these identifiers being deemed to have been made by him/her.

The Advertiser must immediately inform CPARICI by e-mail at annonceur@cparici.com if he notices any fraudulent use of his Account. The Advertiser acknowledges that CPARICI is entitled to take any necessary action to remedy the situation.

14.3 Concerning the Visitor's account

If the visitor has an account. He certifies the accuracy of the information provided at the time of registration. He acknowledges that this information is proof of his identity and commits him as soon as it is validated,

14.4 Concerning use of the Services

The Advertiser is responsible for his use of the Services and for the information he shares in this context. He undertakes to use the Services in his own name and not to transfer them or allow them to be used by a third party.

The Advertiser undertakes to use the Services exclusively for the purposes intended and refrains from any misuse, in particular to: carry out illegal or fraudulent activities, undermine public order or morality, harm third parties or their rights in any way whatsoever, breach any contractual, legislative or regulatory provision, undertake actions likely to compromise the integrity or security of third-party computer systems, promote its own services or those of a third party in an inappropriate manner, or encourage others to commit such acts. 

The Advertiser and the Visitor undertake not to copy, modify or misappropriate any element belonging to CPARICI or any concept exploited within the framework of the Services. They are prohibited from adopting any behavior likely to interfere with CPARICI's computer systems or compromise its security measures. The use of automated systems or software to extract data from the Internet site (commonly known as "screen capture"), whether for commercial or non-commercial purposes, is strictly prohibited. The Advertiser and the Visitor also undertake not to prejudice the financial, commercial or moral rights and interests of CPARICI, nor to market, transfer or give access, in any way whatsoever, to the Services, to the information hosted on the Internet site to CPARICI.

The Advertiser is fully responsible for the content of any kind published within the framework of the Services. The Advertiser acknowledges that content published on the website is made public and may be consulted by other website users.

The Advertiser and the Visitor undertake not to publish any content (non-exhaustive list) that: violates public order or morality (pornographic, obscene, offensive, inappropriate for a family audience, defamatory, abusive, violent, racist, xenophobic or hateful content), infringes the rights of third parties (counterfeit content, infringement of personality rights, etc.), contravenes any legal, regulatory or contractual provision in force, is prejudicial to third parties in any way whatsoever, contains false or misleading information or incites to illegal or fraudulent practices, or is malicious or fraudulent.), contravene any legal, regulatory or contractual provision in force, prejudice third parties in any way whatsoever, contain false or misleading information or incite illegal, fraudulent or malicious practices, or are likely to harm the computer systems of third parties.

The Advertiser is responsible for all formalities and payments required in connection with the use of the Services. CPARICI cannot be held liable in any way in this respect.

The Advertiser and the Visitor guarantee CPARICI against any claim and/or action that may be brought against it for failure to comply with any of its obligations. The Advertiser or the Visitor shall indemnify CPARICI for any loss suffered and shall reimburse all sums that the latter may be required to pay in this respect.

15. Responsibility and Obligations of CPARICI

CPARICI undertakes to provide the Services with professionalism and care, while being subject only to an obligation of means.

The Advertiser and the Visitor acknowledge that the use of the Services requires an Internet connection. CPARICI cannot be held responsible for the quality of this connection.

15.1 Concerning the quality of Services

CPARICI makes every effort to provide Advertisers and Visitors with quality Services. To this end, regular checks are carried out to ensure the proper functioning and accessibility of the Services on the Web. CPARICI may also carry out maintenance operations under the conditions defined in the "Maintenance" article.

CPARICI cannot be held responsible for temporary difficulties or interruptions in access to the Services resulting from : circumstances external to its network (in particular a partial or total failure of the servers of CPARICI's host), incompatibility between extensions, failure of the theme, failures of cabling equipment, services or networks not included in its Services or outside its responsibility, interruptions caused by telecom operators or Internet access providers, interventions by the Advertiser such as incorrect configuration of the Services, or any case of force majeure.

Furthermore, CPARICI does not guarantee that the :

CPARICI does not guarantee that the services specifically meet the needs and expectations of the advertiser or the Visitor. As the services are standard, they cannot be adapted to the advertiser's or visitor's personal constraints.

15.2 Concerning the CPARICI website service level guarantee

CPARICI makes every effort to ensure uninterrupted access to the website 24 hours a day, 7 days a week, except in the event of scheduled maintenance in accordance with the provisions of the "Maintenance" article or in the event of force majeure.

15.3 Backup of data on the CPARICI website

CPARICI makes every effort to ensure the backup of data generated and/or entered on the website, but cannot be held responsible for any loss of data during maintenance operations.

15.4 Data security

CPARICI makes every effort to ensure data security by implementing measures to protect the website infrastructure, detecting and preventing malicious acts and recovering data in the event of an incident.

15.5 Concerning messaging and e-mail

CPARICI cannot guarantee that no third party can access or intercept messages exchanged via the Internet site's messaging system. CPARICI makes its best efforts to ensure protection.

CPARICI acts as a service provider for the content published by the Advertiser on the Website. Consequently, CPARICI declines all responsibility for such content.

If CPARICI is informed of the presence of illegal content, CPARICI will promptly take the necessary measures to remove or block access to it and may apply the penalties provided for in the relevant article.

15.7 Concerning the Advertiser-Visitor Connection Service

CPARICI acts as an intermediary between Visitors and Advertisers.

CPARICI cannot be held responsible for relations between Advertisers and Visitors, nor can it be involved in any disputes.

CPARICI does not intervene in rental or reservation contracts concluded between Advertisers and Visitors, and cannot be held liable for any difficulties encountered during the conclusion or execution of these contracts.

CPARICI does not guarantee the compliance of goods and services with applicable laws and regulations.

CPARICI does not guarantee any volume of business that the Advertiser may generate through the use of the Services.

16. Limitation of liability 

CPARICI's liability is strictly limited to direct and proven damages suffered by the Advertiser as a result of the use of the Services. CPARICI shall not be liable for more than the amounts it received during the 12 months preceding the event giving rise to liability, or the duration of the provision of its services, if this duration is shorter.

CPARICI cannot be held liable for any dispute arising from the relationship between the Advertiser and the Visitor.

17. CPARICI's respective confidentiality obligations

Except with the prior written agreement of the other party, each party undertakes to maintain the confidentiality of all information held or communicated by the other party, of which it may have become aware in the context of the conclusion and performance of their contractual relationship, for the entire duration of said relationship.

This obligation does not extend to information lawfully received from a third party, the disclosure of which is required by judicial authorities in accordance with applicable laws and regulations, or in order to enforce the rights of a party in the performance of the contract binding the parties.

18. Force majeure

The parties shall not be held liable for any failure or delay in the performance of their contractual obligations due to force majeure occurring during the term of their contractual relationship. Force majeure means :

any case meeting the conditions of article 1218 of the French Civil Code and recognized by case law,

strikes, terrorist activities, riots, insurrections, wars, government actions, epidemics, natural disasters or defects attributable to a third-party telecommunications provider.

The prevented party remains obliged to fulfil its obligations that are not affected by the force majeure event, as well as any payment obligations.

19. End of Listing Services

Cancellation of the Subscription must be made no later than one month before the end of the current period, by :

Any Period started is due in full.

CPARICI reserves the right to delete any Account that has remained inactive for a continuous period exceeding 24 months.

20. Penalties for breaches

The following are essential and mandatory obligations:

payment of the Subscription price for the Services ,

provide truthful, complete information,

respect the rules of politeness and courtesy when dealing with visitors and CPARICI

not to circumvent the Services, nor to use them for a third party,

refrain from using automated systems or software to extract data from the website (commonly known as "scraping"), whether for commercial or non-commercial purposes,

refrain from any illegal or fraudulent activity, or any activity likely to infringe the rights or safety of third parties, disturb public order or violate applicable laws and regulations.

In the event of non-compliance with any of these essential and mandatory obligations, CPARICI may take the following measures: suspend or remove the Advertiser's access to the Services, remove any content related to the breach, publish on the Website any information deemed necessary by CPARICI, report the breach to the competent authorities and cooperate with them by providing them with the relevant information, as well as take any appropriate legal action.

These sanctions are without prejudice to any damages that CPARICI may claim from the Advertiser.

In the event of breach of any obligation other than an Essential Obligation, CPARICI will notify the Advertiser by email to remedy the breach within a maximum period of 15 calendar days. If the breach is not remedied within this period, the Services will be terminated. Termination of Services will result in deletion of the Advertiser's Account.

20. Modification of the General Conditions of Use

CPARICI reserves the right to modify the Terms of Use at any time and will inform Advertisers by email at least 2 weeks before their implementation.

The modified general terms and conditions will come into force as soon as they are published. However, for Services requiring a Subscription, they will apply from the renewal of the current Subscription.

If the Advertiser or the Visitor does not accept these modifications, he must unsubscribe from the Services by following the procedures defined in the "Termination of Services" article.

If the Advertiser continues to use the Services after the entry into force of the modified Terms and Conditions, CPARICI will consider that the Advertiser has accepted them.

21. Individual dispute

In the event of a dispute between the Individual Advertiser and CPARICI, the parties will endeavor to find an amicable solution.

22. Applicable law and jurisdiction

The General Conditions are governed by French law.

In the event of a dispute between the advertiser and CPARICI, and in the absence of an amicable agreement within 2 months of the first notification, the dispute will be submitted to the exclusive jurisdiction of the courts of Saintes (France), except in the case of mandatory provisions.

Registration automatically leads to the opening of an account in the Visitor's name (the "Account"), enabling the Visitor to manage his or her use of the Services on the Site, using his or her login and password.

7. Service description

Advertisers and Visitors acknowledge that use of the services requires an Internet connection, for which CPARICI cannot be held responsible.

Within the framework of the Services, the Advertiser and the Visitor are informed and expressly acknowledge that CPARICI offers a service to put Advertisers and Visitors in contact with each other via the Internet site, enabling them to find a good or service.

Any visitor can freely search, view ads and contact advertisers without having to register.

CPARICI provides a link between Advertisers and visitors and cannot be held responsible for any dispute, whether material or immaterial, arising from the relationship between these parties.

7.1 Matchmaking service

CPARICI offers advertisers a space ('an ad page') for a limited period of time, which may be consulted by Visitors. CPARICI cannot be held responsible for any disputes arising between the parties (damages, payments, etc.).

The use of and/or connection to the website via an account does not constitute a travel or holiday contract within the meaning of the French Tourism Code and does not constitute a service contract with the advertiser.

CPARICI does not intervene in contracts concluded directly between Advertisers and Visitors. CPARICI does not position itself as a travel agency, insurer or organizer in accordance with Directive (EU) 2015/2302.

7.2 Creating and publishing Advertisements

After creating their account and making payment, Advertisers may publish Ads, after validation by CPARICI, including descriptions and photos. Advertisers undertake to provide accurate information and to comply with any applicable legal declarations or prior authorization requirements. (article L.324-1-1 of the French Tourism Code, articles L.631-7 et seq. of the French Construction and Housing Code)

The Advertiser undertakes to write the description of the services or goods in the Advertisements in a sincere, truthful and complete manner, providing precise and objective information corresponding to the actual characteristics of the services and goods.

The Advertiser undertakes not to offer any goods or services whose characteristics differ from those indicated in the Ad.

Ads are classified according to criteria defined by CPARICI.

7.3 Viewing ads

CPARICI offers Visitors the possibility of searching and viewing Advertisements on the Website.

7.4 Control panel

Advertisers can, via their Account: modify the characteristics of their ads, indicate their availability, ato their own terms and conditions, complete their profile.

7.5 Contacting Hosts

CPARICI offers Visitors interested in a service or property to rent, the possibility of contacting the Advertisers to obtain specific information on the services and properties to be rented by means of a form to be completed, proposed for this purpose and accessible on the Internet site.

The Advertiser will receive the information request by email.

The Visitor may also be invited to visit the Advertiser's website if the latter has one. Each professional can add a direct link to its own website, however, links to third-party booking platforms (such as Airbnb, Booking, etc.) are not permitted.. Also theLinks to websites that charge a commission to the service provider are not permitted when direct booking is possible either via the cparici website or via any other medium. Indeed Cparici's objective is to promote direct booking and create a a simple, responsible human link between travelers and local tourism players.

Visitors acknowledge and accept that : 

The e-mail service is not infallible and depends on the connection and access providers to the telephone network and Internet over which CPARICI has no control;

7.6 Reservation request service

Visitors can contact Advertisers via a form on the website. The Advertiser receives requests directly by email.

Visitors can also contact the advertiser directly via the "live booking request" button, which includes a link to the advertiser's website. Each professional can add a direct link to its own website, however, links to third-party booking platforms (such as Airbnb, Booking, etc.) are not permitted.. Links to websites that charge a commission to the service provider are also not permitted, when direct booking is possible either via the cparici website or via any other medium.  Indeed Cparici's objective is to promote direct booking and create a a simple, responsible human link between travelers and local tourism players. It is also possible tointegrate an availability calendar directly on the ad.

Advertisers acknowledge that the reception of messages may depend on their access provider and may generate charges.

If a reservation request is successful, the conclusion of the service or property rental contract, payment and management of the rental terms (arrival and departure times, services provided, etc.) will be carried out directly between the Advertiser and the Visitor, under their entire responsibility.

7.7 Cancellation policy of the reservation of the service or rental of the property by the Advertiser

Any cancellation of a reservation, whether made by a Professional or Individual Advertiser, is the sole responsibility of the Advertiser and must be made in accordance with the terms and conditions specified by the Advertiser.

7.8 Cancellation policy for reservation of services or rental of property by the Visitor

If the advertiser is a professional, cancellation of the reservation of the service or vacation rental by the Visitor is subject to the terms and conditions defined in the Visitor's general terms and conditions.

In any event, the cancellation request made by the Visitor to the Advertiser is made under the Visitor's sole responsibility and in accordance with the terms and conditions indicated by the Advertiser on the website.

Any complaint or request for reimbursement by the Visitor must be made directly to the Advertiser.

8. Service subscription period

8.1 Subscription period for listing services

The Advertiser, whether Professional or Individual, subscribes to the Services in the form of a subscription (the "Subscription Pack").

The Subscription takes effect from the date of subscription and is valid for an initial period of 12 months, or longer in the case of a specific offer.

The Subscription is automatically renewed for successive periods of 12 months, unless terminated in accordance with the terms and conditions set out in the "Termination of Services" article.

When the Advertiser is an Individual Advertiser, the renewal of the Subscription will be subject to the provisions of articles L215-1 et seq. of the French Consumer Code.

9. CPARICI pricing conditions

9.1 Service prices

For the Advertiser :

The rates for the Subscription taken out by the Advertiser, whether Professional or Individual, are specified on the website.

Any period started as part of the Subscription must be paid in full, with no possibility of partial reimbursement.

Other services other than advertisements are subject to a specific quote depending on the services offered by CPARICI.

For the Visitor : 

The Services are provided to Visitors free of charge.

9.2 Prices for Services and rental properties

The prices of services and rentals are indicated in the Advertisements and are set directly by the Advertisers.

Prices are quoted in euros and include all taxes. Prices may be modified at any time by the Advertisers. Additional costs may be added to the Price, payable directly to the Advertiser. Consequently, the Visitor acknowledges that it is his responsibility to check any additional costs that may be added to the Price indicated on the website.

9.3 CPARICI invoicing and payment methods

About the Announcement Service

As part of the Advertising Services, CPARICI will send the Advertiser, whether Professional or Individual, an invoice for the Subscription for each period.

Payment for the Subscription will be made :

By credit card via the secure online payment system available on the website, when subscribing to the Subscription, and each time it is renewed.

By direct debit at each renewal.

Concerning other Services.

For other Services, CPARICI will send the Advertiser an invoice for the service subscribed to by email.

Payment for other Services will be made :

By credit card using the secure online payment service specified on the Platform, each time the said service is subscribed to.

Or by bank transfer.

10. Website maintenance and hosting

10.1 Maintenance

For the duration of the Services, the Advertiser and Visitors benefit from corrective and evolutionary maintenance of the Internet site. As such, access to the website may be temporarily restricted or suspended.

CPARICI undertakes to implement all necessary means to ensure effective corrective maintenance, aimed at resolving any malfunction or anomaly identified on the website.

Within the framework of evolutionary maintenance, the Advertiser and the Visitor benefit, for the duration of the Services, from improvements to the functionalities of the Internet site and the associated technical installations. These improvements may be implemented by CPARICI automatically and without prior notice.

Access to the website may also be restricted or interrupted for planned maintenance operations.

10.2 Hosting

CPARICI ensures, within the framework of an obligation of means, the lodging of the Internet site as well as the data seized by and/or on this one via a professional provider of lodging, located in a country of the European Union.

11. Individual Advertiser's right of withdrawal

The right of withdrawal is valid for 14 calendar days from acceptance of the General Conditions of Use. The Individual Advertiser may exercise this right free of charge by sending his request to CPARICI before the expiry of this period by e-mail to annonceur@cparici.com.

This request must be clear and must include the words "Withdrawal request".

If the Individual advertiser confirms that their ad will be placed online, after having created their ad, they waive their right of withdrawal.

If the Individual Advertiser exercises his right of withdrawal, CPARICI will reimburse all payments received as soon as possible.

12. Legal warranty of conformity to the Individual Advertiser

The legal warranty is applicable to any Individual Advertiser who is a consumer in respect of his or her use of the website.

The consumer has the right to the implementation of the legal guarantee of conformity in the event of appearance of a defect of conformity during the duration of the Services. In this case, the consumer may obtain a refund calculated on a pro rata basis of the Services provided up to the day CPARICI was informed.

CPARICI cannot be held responsible for any interruption of the website due to the host, CMS or extensions.

13. Intellectual property rights

13.1 Intellectual property rights on the website

The website is the property of CPARICI, as are the software, infrastructures, databases and content of all kinds (text, images, visuals, music, logos, trademarks, etc.) that it uses. These elements are protected by current laws on intellectual property and the rights of database producers.

13.2 Intellectual property rights on Content and testimonials

By using the Services, the Advertiser acknowledges that any content it publishes on the website (the "Content") is shared in a spirit of collaboration and community exchange.

The advertiser agrees that CPARICI may publish the Content and testimonials of advertisers on the website and on social networks in France and abroad through any media and medium, in order to promote the website, translate the Content into any language, modify and/or adapt the Content to formats.

By registering on the site, the Visitor acknowledges that the content of any kind that he/she publishes on the Platform, and in particular comments concerning his/her stay (the "Content"), is disseminated in a spirit of community exchange.

He/she authorizes CPARICI to use his/her testimonials, his/her image attached to his/her account on any digital or paper marketing medium for the sole purpose of promoting the website.

14. Advertiser's obligations and liability

14.1 Information provided

The Advertiser agrees to provide CPARICI with all information required for the subscription and use of the Services.

14.2 Concerning the Advertiser's Account

The Advertiser attests to the accuracy of the information provided in the registration form and undertakes to update it regularly. He acknowledges that this information constitutes proof of his identity and binds him as soon as it has been validated. The Advertiser is also responsible for ensuring the confidentiality and security of his/her login and password, all access to the site via these identifiers being deemed to have been made by him/her.

The Advertiser must immediately inform CPARICI by e-mail at annonceur@cparici.com if he notices any fraudulent use of his Account. The Advertiser acknowledges that CPARICI is entitled to take any necessary action to remedy the situation.

14.3 Concerning the Visitor's account

If the visitor has an account. He certifies the accuracy of the information provided at the time of registration. He acknowledges that this information is proof of his identity and commits him as soon as it is validated,

14.4 Concerning use of the Services

The Advertiser is responsible for his use of the Services and for the information he shares in this context. He undertakes to use the Services in his own name and not to transfer them or allow them to be used by a third party.

The Advertiser undertakes to use the Services exclusively for the purposes intended and refrains from any misuse, in particular to: carry out illegal or fraudulent activities, undermine public order or morality, harm third parties or their rights in any way whatsoever, breach any contractual, legislative or regulatory provision, undertake actions likely to compromise the integrity or security of third-party computer systems, promote its own services or those of a third party in an inappropriate manner, or encourage others to commit such acts. 

The Advertiser and the Visitor undertake not to copy, modify or misappropriate any element belonging to CPARICI or any concept exploited within the framework of the Services. They are prohibited from adopting any behavior likely to interfere with CPARICI's computer systems or compromise its security measures. The use of automated systems or software to extract data from the Internet site (commonly known as "screen capture"), whether for commercial or non-commercial purposes, is strictly prohibited. The Advertiser and the Visitor also undertake not to prejudice the financial, commercial or moral rights and interests of CPARICI, nor to market, transfer or give access, in any way whatsoever, to the Services, to the information hosted on the Internet site to CPARICI.

The Advertiser is fully responsible for the content of any kind published within the framework of the Services. The Advertiser acknowledges that content published on the website is made public and may be consulted by other website users.

The Advertiser and the Visitor undertake not to publish any content (non-exhaustive list) that: violates public order or morality (pornographic, obscene, offensive, inappropriate for a family audience, defamatory, abusive, violent, racist, xenophobic or hateful content), infringes the rights of third parties (counterfeit content, infringement of personality rights, etc.), contravenes any legal, regulatory or contractual provision in force, is prejudicial to third parties in any way whatsoever, contains false or misleading information or incites to illegal or fraudulent practices, or is malicious or fraudulent.), contravene any legal, regulatory or contractual provision in force, prejudice third parties in any way whatsoever, contain false or misleading information or incite illegal, fraudulent or malicious practices, or are likely to harm the computer systems of third parties.

The Advertiser is required to comply with all applicable tax and social security obligations in the event of contact with other users via the website. CPARICI strongly recommends that the Advertiser contact the relevant departments for information on this subject.

The Advertiser is responsible for all formalities and payments required in connection with the use of the Services. CPARICI cannot be held liable in any way in this respect.

The Advertiser and the Visitor guarantee CPARICI against any claim and/or action that may be brought against it for failure to comply with any of its obligations. The Advertiser or the Visitor shall indemnify CPARICI for any loss suffered and shall reimburse all sums that the latter may be required to pay in this respect.

15. Responsibility and Obligations of CPARICI

CPARICI undertakes to provide the Services with professionalism and care, while being subject only to an obligation of means.

The Advertiser and the Visitor acknowledge that the use of the Services requires an Internet connection. CPARICI cannot be held responsible for the quality of this connection.

15.1 Concerning the quality of Services

CPARICI makes every effort to provide Advertisers and Visitors with quality Services. To this end, regular checks are carried out to ensure the proper functioning and accessibility of the Services on the Web. CPARICI may also carry out maintenance operations under the conditions defined in the "Maintenance" article.

CPARICI cannot be held responsible for temporary difficulties or interruptions in access to the Services resulting from : circumstances external to its network (in particular a partial or total failure of the servers of CPARICI's host), incompatibility between extensions, failure of the theme, failures of cabling equipment, services or networks not included in its Services or outside its responsibility, interruptions caused by telecom operators or Internet access providers, interventions by the Advertiser such as incorrect configuration of the Services, or any case of force majeure.

Furthermore, CPARICI does not guarantee that the :

CPARICI does not guarantee that the services specifically meet the needs and expectations of the advertiser or the Visitor. As the services are standard, they cannot be adapted to the advertiser's or visitor's personal constraints.

15.2 Concerning the CPARICI website service level guarantee

CPARICI makes every effort to ensure uninterrupted access to the website 24 hours a day, 7 days a week, except in the event of scheduled maintenance in accordance with the provisions of the "Maintenance" article or in the event of force majeure.

15.3 Backup of data on the CPARICI website

CPARICI makes every effort to ensure the backup of data generated and/or entered on the website, but cannot be held responsible for any loss of data during maintenance operations.

15.4 Data security

CPARICI makes every effort to ensure data security by implementing measures to protect the website infrastructure, detecting and preventing malicious acts and recovering data in the event of an incident.

15.5 Concerning messaging and e-mail

CPARICI cannot guarantee that no third party can access or intercept messages exchanged via the Internet site's messaging system. CPARICI makes its best efforts to ensure protection.

15.6 Concerning the publication of content

CPARICI acts as a service provider for the content published by the Advertiser on the Website. Consequently, CPARICI declines all responsibility for such content.

If CPARICI is informed of the presence of illegal content, CPARICI will promptly take the necessary measures to remove or block access to it and may apply the penalties provided for in the relevant article.

15.7 Concerning the Advertiser-Visitor Connection Service

CPARICI acts as an intermediary between Visitors and Advertisers.

CPARICI cannot be held responsible for relations between Advertisers and Visitors, nor can it be involved in any disputes.

CPARICI does not intervene in rental or reservation contracts concluded between Advertisers and Visitors, and cannot be held liable for any difficulties encountered during the conclusion or execution of these contracts.

CPARICI does not guarantee the compliance of goods and services with applicable laws and regulations.

CPARICI does not guarantee any volume of business that the Advertiser may generate through the use of the Services.

16. Limitation of liability 

CPARICI's liability is strictly limited to direct and proven damages suffered by the Advertiser as a result of the use of the Services. CPARICI shall not be liable for more than the amounts it received during the 12 months preceding the event giving rise to liability, or the duration of the provision of its services, if this duration is shorter.

CPARICI cannot be held liable for any dispute arising from the relationship between the Advertiser and the Visitor.

17. CPARICI's respective confidentiality obligations

Except with the prior written agreement of the other party, each party undertakes to maintain the confidentiality of all information held or communicated by the other party, of which it may have become aware in the context of the conclusion and performance of their contractual relationship, for the entire duration of said relationship.

This obligation does not extend to information lawfully received from a third party, the disclosure of which is required by judicial authorities in accordance with applicable laws and regulations, or in order to enforce the rights of a party in the performance of the contract binding the parties.

18. Force majeure

The parties shall not be held liable for any failure or delay in the performance of their contractual obligations due to force majeure occurring during the term of their contractual relationship. Force majeure means :

any case meeting the conditions of article 1218 of the French Civil Code and recognized by case law,

strikes, terrorist activities, riots, insurrections, wars, government actions, epidemics, natural disasters or defects attributable to a third-party telecommunications provider.

The prevented party remains obliged to fulfil its obligations that are not affected by the force majeure event, as well as any payment obligations.

19. End of Listing Services

Cancellation of the Subscription must be made no later than one month before the end of the current period, by :

Any Period started is due in full.

CPARICI reserves the right to delete any Account that has remained inactive for a continuous period exceeding 24 months.

20. Penalties for breaches

The following are essential and mandatory obligations:

payment of the Subscription price for the Services ,

provide truthful, complete information,

respect the rules of politeness and courtesy when dealing with visitors and CPARICI

not to circumvent the Services, nor to use them for a third party,

refrain from using automated systems or software to extract data from the website (commonly known as "scraping"), whether for commercial or non-commercial purposes,

refrain from any illegal or fraudulent activity, or any activity likely to infringe the rights or safety of third parties, disturb public order or violate applicable laws and regulations.

In the event of non-compliance with any of these essential and mandatory obligations, CPARICI may take the following measures: suspend or remove the Advertiser's access to the Services, remove any content related to the breach, publish on the Website any information deemed necessary by CPARICI, report the breach to the competent authorities and cooperate with them by providing them with the relevant information, as well as take any appropriate legal action.

These sanctions are without prejudice to any damages that CPARICI may claim from the Advertiser.

In the event of breach of any obligation other than an Essential Obligation, CPARICI will notify the Advertiser by email to remedy the breach within a maximum period of 15 calendar days. If the breach is not remedied within this period, the Services will be terminated. Termination of Services will result in deletion of the Advertiser's Account.

20. Modification of the General Conditions of Use

CPARICI reserves the right to modify the Terms of Use at any time and will inform Advertisers by email at least 2 weeks before their implementation.

The modified general terms and conditions will come into force as soon as they are published. However, for Services requiring a Subscription, they will apply from the renewal of the current Subscription.

If the Advertiser or the Visitor does not accept these modifications, he must unsubscribe from the Services by following the procedures defined in the "Termination of Services" article.

If the Advertiser continues to use the Services after the entry into force of the modified Terms and Conditions, CPARICI will consider that the Advertiser has accepted them.

21. Individual dispute

In the event of a dispute between the Individual Advertiser and CPARICI, the parties will endeavor to find an amicable solution.

22. Applicable law and jurisdiction

The General Conditions are governed by French law.

In the event of a dispute between the advertiser and CPARICI, and in the absence of an amicable agreement within 2 months of the first notification, the dispute will be submitted to the exclusive jurisdiction of the courts of Saintes (France), except in the case of mandatory provisions.
